These terms cover the OverDub iOS app. They also serve as the End-User License Agreement (EULA) for the App Store. The final, dated version ships with the App Store release; this pre-launch draft reflects its substance.
By downloading or using OverDub (the “App”), you agree to these Terms. If you do not agree, do not use the App.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, in accordance with Apple’s App Store Terms and these Terms. You may not copy, modify, reverse-engineer, redistribute, or resell the App except as permitted by law.
You retain all rights to the audio you record and the projects and exports you create with the App. We claim no ownership of your content and never access it — it stays on your device (see the Privacy notice). You are responsible for your content and for having the rights to anything you record.
Use the App lawfully. Do not use it to record people without consent where consent is required, or to infringe anyone’s rights.
The App plays a brief calibration tone through your device speaker to measure your room. The tone is band-limited and level-capped, but you are responsible for sensible playback levels and your environment. Timing/sync, latency, room-measurement accuracy, and audio results depend on your hardware, environment, and audio route and may vary; the App surfaces its measured tolerance rather than promising a fixed number.
The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant uninterrupted or error-free operation, or any specific audio, latency, or measurement outcome.
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, recordings, or profits, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid for it (if any) in the 12 months before the claim. Back up recordings you care about.
OverDub is free to download. An optional one-time “OverDub Pro” unlock (a non-consumable in-app purchase) unlocks the full feature set; there is no subscription. All purchases are handled by Apple under the App Store Terms; refunds are requested through Apple, not us.
We may update the App and these Terms. Material changes will be posted at this URL with an updated effective date; continued use after changes means you accept them.
This license ends if you violate these Terms or delete the App. The “your content,” warranty, liability, and governing-law sections survive termination.
These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-laws rules, to the extent permitted by law.
